Dauntless Manufacturing – Terms & Conditions of Sale

By purchasing products from Dauntless Manufacturing (“Dauntless,” “we,” “our,” or “us”) through our website, you (“Customer” or “you”) agree to the following Terms & Conditions. Please read them carefully before completing your purchase.

1. Compliance with Local, State, and Federal Laws

• By purchasing any product from Dauntless, you represent and warrant that you are of legal age and that it is lawful for you to purchase, own, and possess such products in your jurisdiction.

• It is solely your responsibility to know and comply with all applicable local, state, federal, and international laws regarding the possession, use, carry, shipping, and resale of our products.

• Dauntless assumes no responsibility for misuse or unlawful possession of its products.

2. Release, Assumption of Risk, Waiver of Liability, and Indemnity Agreement

• By purchasing or receiving any Dauntless product, you expressly acknowledge and agree that knives, tools, and related products can be dangerous if misused.

• You voluntarily assume all risks of injury, harm, or loss that may arise from possession, use, misuse, or handling of any product purchased from Dauntless.

• To the fullest extent permitted by law, you agree to release, waive, and discharge Dauntless Manufacturing, its owners, employees, and affiliates from any and all claims, demands, or liabilities, including but not limited to personal injury, death, property damage, or economic loss, whether arising from negligence or otherwise.

• You further agree to indemnify and hold harmless Dauntless from any claims, actions, damages, costs, or expenses (including attorneys’ fees) resulting from your purchase, possession, or use of our products.

3. Returns and Exchanges

• We stand behind the quality of our products and offer a lifetime warranty against defects in materials or workmanship.

• Returns for refund or exchange are accepted only for unused products in original condition within 60 days of delivery. Proof of purchase is required.

• Custom, limited, or serialized products may not be eligible for return except in the case of manufacturer defect.

• Shipping fees are non-refundable, and return shipping costs are the responsibility of the customer unless the return is due to a Dauntless error.

4. Lost or Stolen Merchandise

• Once an order is delivered by the carrier and marked as “Delivered” to the shipping address provided, responsibility for the package transfers to the customer.

• Dauntless is not responsible for packages that are lost, stolen, or misdelivered due to incorrect information provided at checkout.

• If your package is lost in transit (before delivery confirmation), please contact us promptly so we may assist with a claim. Final resolution may be subject to the carrier’s investigation and limited to the amount that the carrier pays on any claim.

5. Limitation of Liability

• To the maximum extent permitted by law, Dauntless shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the purchase, possession, or use of our products.

• In no event shall Dauntless’s total liability exceed the purchase price of the product in question.

6. Governing Law and Jurisdiction

• These Terms & Conditions shall be governed by and construed under the laws of the State of North Carolina, without regard to its conflict of laws principles.

• Any disputes shall be brought exclusively in the state or federal courts located in Randolph County, North Carolina.

7. Amendments

• Dauntless reserves the right to update or modify these Terms & Conditions at any time without prior notice. The version posted on our website at the time of your order will apply to your purchase.
